PETITION FOR CANCELLATION OF ANTICIPATORY BAIL Under Sec. 483(2) of BNSS.

PRAYER :- To cancel the anticipatory bail order granted by the learned Principal District and Sessions Judge, Madurai to the 1st and 2nd respondents herein in Crl.M.P.No.4368 of 2025 dated 24.09.2025. ORDER: The Court made the following order :- This Criminal Original Petition has been filed seeking cancellation of the anticipatory bail granted to the 1st and 2nd respondents/accused in Crl.M.P. No.4368 of 2025 by the learned Principal District and Sessions Judge, Madurai, on 24.09.2025.

2. Heard the learned Government Advocate (Criminal Side) appearing for the 3rd respondent/police.

It is the contention of the learned counsel for the petitioner/de-facto complainant that the 1st and 2nd respondents/accused have violated the conditions of the anticipatory bail order and have also threatened the de-facto complainant. She further contended that, in any loan or monetary transaction, some deposit should have been directed while granting anticipatory bail, which was not considered in the order.

4. However, there is no evidence to substantiate these allegations. The de-facto complainant has not preferred any police complaint. Therefore, these allegations cannot be entertained. As regards the contention that a deposit should have been directed, the decision to grant anticipatory bail, with or without such a condition, is within the discretion of the concerned Court and the same cannot be questioned. Therefore, the present petition seeking cancellation of anticipatory bail cannot be considered.

5. The prosecution shall proceed with the investigation and file a charge sheet at the earliest.

6. Accordingly, this Criminal Original Petition is dismissed. 18.11.2025 mkn 3/5
