Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus directing the 2nd Respondent herein to conduct the enquiry for cancelling the fraudulent certificate of death obtained for 1/4

Thogaimayil issued on 22.02.2023 by the 4th respondent by considering the petitioner's representation dated 11.12.2023, in accordance with law, within the time stipulated by this Court.

ORDER

This Writ Petition has been filed to direct the second respondent to conduct enquiry and cancel the fraudulent certificate of death issued by the fourth respondent for Thogaimayil on 22.02.2023, by considering the petitioner's representation dated 11.12.2023, in accordance with law.

2. The learned counsel appearing for the petitioner would submit that the petitioner has given a representation on 11.12.2023 to conduct enquiry and cancelling the fraudulent Death Certificate issued by the fourth respondent for Thogaimayil on 22.02.2023. However, the same is yet to be considered. Hence, the Writ Petition.

3. The learned Additional Government Pleader appearing for the respondents 1 to 4 would submit that the representation submitted by the petitioner will be considered within the time stipulated by this Court. 2/4

In view of the same, without expressing any opinion on the merits of the matter, this Court directs the second respondent to consider the representation of the petitioner dated 11.12.2023, conduct enquiry after issuing notice to all the parties and dispose of the same, on its own merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition stands disposed of. No costs.
