PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned suspension order issued by the third respondent dated 23.08.2025 vide Na.Ka.No. A1/685/2025 and quash the same and consequently directing the respondents to reinstate the petitioner into service in the tasmac Shop No. 7664 along with backwages within the time stipulated by this Court. ORDER

The petitioner has challenged the order of suspension in this writ petition.

2. An order of interim stay had been granted, recording the fact that the subsistence allowances had not been paid to the petitioner.

3. An order of interim stay had been granted by this Court on 13.10.2025. However, the respondents filed an application to vacate the interim stay, wherein they have stated that the subsistence allowance was 2/5

paid on 31.10.2025, which is after the interim stay was granted by this Court.

4. The conduct of the respondents to move the vacate stay petition on the ground that they have paid the subsistence allowances on a subsequent date to the interim order and the respondents are not willing to comply with the order to reinstate the petitioner into service.

5. For the above reasons alone, the impugned order of suspension is set aside with a direction to the respondents to reinstate the petitioner into service and to pay all the monetary benefits to him. Now, the charge memo has been issued to the petitioner and the respondents are directed to conclude the disciplinary proceedings within a period of 12 weeks from the date of receipt of a copy of this order.

6. With the above directions, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petitions are closed. 11.11.2025 TTA 3/5
