ORDER: The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 406, 420, 506(2) of IPC, in 1/6

Crime No.21 of 2025, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the Defacto Complainant and the 1st Accused are family members, and the 1st Accused have been doing a business of Rice Mill under the name and style of "Ramesh Modern Rice Mill". Due to his business development, he borrowed a sum of Rs.3,90,00,000/- in several installments. On the assurance of the 2nd, 3rd and 4th Accused, who are brothers and sisters of the 1st Accused, the Defacto Complainant gave the money. The 4th Accused is the person who takes care of Government works. For the work the Defacto Complainant gave Rs.40,00,000/- to the 4th Accused. Further Rs. 4,30,00,000/- in total was given to the Accused. On 20.01.

2023, when the defacto complainant asked to return the said amount, all the Accused threatened to cause danger to the defacto complainant's life, abused using filthy language and have cheated the petitioner. Hence, the apprehension of arrest. Hence, a case has been registered as against the petitioner. 3.The learned counsel appearing for the petitioner submitted that the petitioner / 4th accused is the sister of 1st accused and she is living in Trichy and she is no way connected to the transaction.

to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl. side) appearing for the respondent submitted that the offences committed by the petitioner are serious in nature.

5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. 6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Judicial Magistrate Court No.VI, Tiruchirappalli, within a period of fifteen days from the date of receipt of a copy of this order, on further conditions that: [a]the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity. [b]the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of four weeks and thereafter, as and when required for 3/6

interrogation. The petitioner shall cooperate with the investigation. [c]the petitioner shall not tamper with the evidence or witness either during investigation or trial.

[d]the petitioner shall not abscond either during investigation or trial. [e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
