O R D E R

This writ petition has been filed for a writ of Mandamus to direct the respondents to disburse the retirement benefits of the petitioner and the monthly pension with arrears along with the applicable interest by considering the petitioner's representation dated 11.09.2025.

When the matter was taken up for hearing, the learned counsel for the Additional Government Pleader for the respondents 2 and 3 had placed on record the written instructions received from the third respondent indicating that the proposal originally sent by the Department had been modified in view of the objections raised by the first respondent and the petitioner's pay was refixed. In view of such refixation, it was found that the petitioner is liable to repay a sum of Rs.18,41,787/-. Therefore, after deducting the said amount, necessary 2/5

instructions have been issued to the Treasury Office, Peravurani, for disbursal of the remaining amount on 30.09.2025. It is further noted that the order of refixation has not yet been served upon the petitioner.

3. In view of the aforesaid facts, the writ petition stands disposed of with the following directions:

(i) The third respondent is directed to ensure that the petitioner shall be paid the admitted terminal benefits within a period of four weeks from the date of receipt of a copy of this order. (ii) The third respondent is also directed to serve the order of refixation of the petitioner's salary and the order of recovery within a period of two weeks from the date of receipt of a copy of this order, so as to enable the petitioner to challenge the same, if he is so aggrieved. There shall be no order as to costs.
