To call for the records and set aside the order of conviction and sentence confirmed by the Additional Sessions Court in CA.No.34/2014 dt.14/9/2022 convicting the revision petitioner in SC No.72/2008 of Assistant Sessions Court, Kuzhithurai dated 04.07.2014 for the offences u/s.452 IPC -to undergo rigorous imprisonment for three years and to pay a fine of Rs.1000/- in default to undergo simple imprisonment for six months. For the offence u/s.307 IPC convicted and sentenced to undergo rigorous imprisonment for seven years and to pay a fine of Rs.1000/- in default to undergo simple inprisonment for six months and imprisonment is to run concurrently and set aside the same and acquit the appellant / accused.

Order : This Criminal Miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.SREENIVASAN.M.R, Advocate for the petitioner and of MR.A.THIRUVADI KUMAR, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This petition has been filed to relax the condition imposed on the petitioner in Crl.M.P.(MD)No.11917 of 2022 on 02.12.2022.
2.The learned counsel for the petitioner submitted that the petitioner has been complying with the condition imposed by this court regularly from 02.12.2022. 3.The learned Additional Public Prosecutor submitted that the petitioner has been complying with the condition regularly and investigation is pending. 4.Considering the nature of offence, the condition imposed by this court in Crl.M.P.(MD)No.11917 of 2022 on 02.12.2022 is modified to the effect that the petitioner shall report before the concerned Court once in a month i.e., on the first working day of every English calendar month at 10.30 a.m., until further orders. sd/- 09/01/2024 / TRUE COPY / /01/2024 Sub-Assistant Registrar (C.S.
