O R D E R

The petitioner is accused in the complaint given by the respondent herein under Section 138 of the Negotiable Instruments Act.

2. The petitioner filed an application in Cr.M.P.No.1850 of 2012 for staying the entire proceedings in C.C.No.17 of 2012, till the disposal of C.C.No.77 of 2012, pending on the file of the Judicial Magistrate No.I, Tirunelveli. The Court below, after considering the entire material in the interest of justice, dismissed the application. Hence, challenging the dismissal order, the present revision has been filed.

3. Today, when the matter is taken up for hearing, the learned counsel for the respondent has filed a memo stating that the respondent was died and the legal heirs are not taking any step to implead them as parties.

4. In the above circumstances, I am of the view the Criminal Revision Petition stands abated. Accordingly, the

Criminal Revision Petition is disposed of. Consequently, the connected Miscellaneous Petition is closed.
