O R D E R
The petitioner was found guilty of the offence under Section 138 of Negotiable Instruments Act by the Courts below and sentenced to imprisonment and also directed to pay compensation. 2.When the matter was taken up for hearing, the learned counsel appearing for the revision petitioner submitted that he would not challenge the conviction imposed on the petitioner but he wants some leniency to be shown in the matter of sentence alone. In this view of the matter, the sentence of imprisonment imposed on the petitioner is set aside. The petitioner is directed to pay the compensation amount of Rs.2,00,000/- to the respondent/complainant within a period of three months from the date of receipt of a copy of this order. He shall do so by depositing the said amount of Rs.2,00,000/- to the credit of C.C.No.
73 of 2005, on the file of the learned Judicial Magistrate No.IV, Tirunelveli. The complainant is at liberty to withdraw the said amount because this amount represents the compensation payable to him. If the petitioner does not pay the said amount within a period of three months as indicated above, the sentence imposed by the First Appellate Court stands restored.
