ORDER : The Court Made the following order :- The petitioner / Sole Accused, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 341, 294(b), 352 and 506(ii) of I.P.C. and Section 4 of TNPWH Act, 2002 in Crime No.237 of 2023, on 1/3

the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that on 18.11.2023, at about 04.15 P.M., the petitioner waylaid the victims / school students by showing knife in his hand and abused them by using filthy language and threatened them with dire consequences. Hence, the defacto complainant, who is the Headmaster of the School, made a complaint before the respondent Police and the respondent Police registered a case against the petitioner.

3. The learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated in this case and he has nothing to do with the alleged offence. He would further submit that the defacto complainant misbehaved with the petitioner's niece. Earlier, a complaint has been lodged in this regard and due to the said motive, a false case has been foisted against the petitioner. Hence, he prays for anticipatory bail.

The learned Government Advocate (Criminal Side) appearing for the respondent Police would submit that when the victims went to their house after the School hours, the petitioner / accused waylaid the victims by showing knife in his hand and threatened them dire consequences and abused them by using filthy language.

5. Considering the facts and circumstances of the case and considering the 2/3

victims' statement and also considering the fact that the offence committed by the petitioner is heinous in nature, this Court is not inclined to grant anticipatory bail to the petitioner
