The above petition has been filed seeking orders to restore the appeal in CMA(MD)No.528 of 2014, which was dismissed for non-prosecution, vide order dated 26.09.2025.

2. Mr.C.Karthick, learned counsel undertakes to file vakalat for the respondents 1 and 2.

3.Heard both sides.

4.The learned counsel appearing for the respondents would submit that they are having objections, but they have not specified any objections.

5. It is seen from the records that the matter was directed to be listed under the caption for dismissal and since there was no representation for the appellant, the appeal was dismissed for non-prosecution.

6.Considering the facts and circumstances of the case and also taking note of the reasons assigned, this Court is inclined to allow this petition. Accordingly, this petition is ordered.
