PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the Respondent Nos.1 and 2 herein to conduct survey and demarcate four boundaries in respect of the property comprised in S.Nos.743/3A and 743/4B situated at Ambalaapattu South Revenue Village, Orathanadu Taluk, Thanjavur District with the aid of the respondent No.3 and direct the respondent Nos.1 and 2 to issue survey report on the basis of the application dated 12.02.2025 and 18.09.2025 within a stipulated time period in accordance with law.

ORDER

By relying on sale deed dated 12.12.2022 and patta Nos.2396 and 2400 in the name of the petitioner's father Appadurai, the petitioner had applied for survey of the land in S.Nos.743/3A and 743/4B. The present writ petition relates thereto.

2. Learned Government Advocate submits that action would be initiated on the petitioner's request for survey after issuing notice to owners of relevant adjacent lands. He seeks three months to take necessary measures.

3. On instructions, learned counsel for the petitioner confirms that there is no rival title claim. The petitioner has placed on record both title and revenue records relating to the property. Therefore, a case is made out to act on the petitioner's application. He also confirms that there are no other legal heirs of Appadurai.

Accordingly, this writ petition is disposed of by directing the first and second respondents to initiate action on the petitioner's request for survey after issuing notice to owners of relevant adjacent lands and considering objections, if any, from them.
