Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, to call for the records of the impugned demand notice passed by the fourth respondent vide Na.Ka.No.618-2/2019/Kanimam(Rs.) dated 31.07.2025 despite the pending statutory appeal before the third respondent pertaining to the lease granted in favour of the petitioner to quarry rough stone in S.F.No.486/1 over an extent of 0.98.0 Hec. in Government land situated in Bodikommonvide Village, Athoor Taluk, Dindigul District quash the same as illegal.

2. The petitioner suffered an adverse order dated 12.11.2024 at the hands of the District Collector, Dindigul. 2/5

3 W.P.(MD)NO.29441 OF 2025 Challenging the same, the petitioner filed an appeal before the Commissioner of Geology and Mining, Chennai on 11.12.2024. The appeal is still pending. In the meanwhile, the impugned demand had been made. Challenging the same, this writ petition has been filed.

3. When the primary order has not been stayed, the fourth respondent cannot be faulted for having attempted to enforce the same. However, taking note of the fact that the appeal has already been preferred, I direct the fourth respondent to keep the impugned demand dated 31.07.2025 on hold for a period of four months. The third respondent shall dispose of the appeal filed by the petitioner in the meanwhile. This writ petition stands disposed of accordingly. No costs.
