J U D G M E N T

[Judgment of the Court was delivered by K.K.SASIDHARAN,J.] The appellant challenged the auction notice, dated 21.01.2002 before the Writ Court. The writ petition was dismissed on merits.

2. When the appeal was taken up for hearing today, the learned counsel for the respondents on instructions submitted that the auction was not conducted on the particular date and the matter is still pending.

3. The appellant is no more. It is open to the legal representatives to challenge the auction notification, in case any such notification is issued by the respondents henceforth.

4. The Writ Appeal is dismissed with the above observation. No costs. Consequently, the connected Miscellaneous Petition is closed.
