ORDER : The Court made the following order :- This is the second bail application. The petitioner/Sole Accused, who was arrested and remanded to judicial custody on 18.05.2025 for the offences punishable under Sections 5(l), 5(j) (ii) r/w 6 of the Protection of Children from Sexual Offences Act, 2012 and Section 351(2) of BNS, 2023 in Crime No.08 of 2025, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner's wife is a Teacher and the victim girl had been attending tuition in her house, wherein, the petitioner had tied up her hands and committed aggravated penetrative sexual assault on the victim girl several times by coercion and due to which, she became pregnant. Hence, the case.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution and that the petitioner is no way connected with the case, a false case has been lodged as against the petitioner. The petitioner is ready and willing to abide any conditions that may be imposed by this Court. He would further submit that the petitioner is in custody from 18.05.2025. Hence, he seeks bail.
4.The learned Additional Public Prosecutor appearing for the respondent police would submit that this is the second bail application. He would further submit that in the statement recorded under Section 183(5) BNSS from the victim girl, it has been stated that the petitioner had tied up her hands and committed 3/6
penetrative sexual assault on the victim girl several times. Hence, he strongly objected to grant bail to the petitioner.
5.Considering the seriousness and gravity of the offence committed by the petitioner and also considering the age of the victim girl and also taking note of the facts that the investigation is in crucial stage and also the fact that if the petitioner is released on bail, he will tamper the evidence, this Court is not inclined to grant bail to the petitioner at this stage.
6. In the result, this Criminal Original Petition is dismissed.
