Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondent herein to consider and dispose of petitioner's appeal dated 26.02.2023 for cancelling wrong sub-division of Survey No.3071/6A2, conduct survey, measurement and fix boundaries of the petitioner's property measuring 60 cents out of 1.20 acres on eastern side in Survey No.3071/6A1, Genguvarpatti Village, Periyakulam Taluk, Theni District, as per his title deeds, within a reasonable time as may be fixed by this Court.

By relying on a settlement deed dated 09.08.2010, the petitioner asserts title to 60 cents in survey No.3071/6. On the ground that patta was erroneously issued to one Chitradevi and Murugeswari in respect of land settled in favour of the petitioner. the petitioner had filed an appeal before the Revenue Divisional Officer on 26.02.2023. The petitioner seeks the early disposal of such appeal.

2. Learned Special Government Pleader accepts notice for the sole respondent. He submits that the Revenue Divisional Officer had issued summons on two occasions and would dispose of the matter on merits after issuing notice to all the pattadars.

3. Patta No.3283 stands in the names of eight persons, including the petitioner. The petitioner's representation refers to the erroneous issuance of patta to Chitradevi and Murugeswari. Therefore, it is necessary to issue notice to them.

Accordingly, without making any observations on the merits, this Writ Petition is disposed of by directing the respondent to consider and dispose of the petitioner's appeal after issuing notice to the pattadars, Chitradevi, Murugeswari and any other persons who would be affected by such order. A speaking order shall be issued within three (3) months from the date of receipt of a copy of this order. No costs.
