PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 25.08.2025 seeking an alternative land for the land purchased by the petitioner in Survey No.1241/2a in Vadaveeranayakanpatti Village, Periyakulam Taluk, Theni District, within the stipulated time that may be fixed by this court. ORDER

The petitioner asserts that he purchased the property under sale deed dated 05.02.1996 from one Guruswamy. Later, on the basis that the survey number was wrongly mentioned as S.No.1237/1 instead of S.No.1241/2a, rectification deed dated 10.09.1996 was executed. Subsequently, the petitioner applied for patta transfer in his name. Such request was rejected on the ground that the land belongs to the forest department. The present writ petition relates thereto.

2.Learned counsel for the petitioner submits that the patta stood in the name of Gurusamy at the time of purchase. However, a copy of such patta is not available.

3.Learned Special Government Pleader accepts notice for all the respondents. He submits that the petitioner is not entitled to any relief, including by way of alternative land, because the petitioner purchased the land which is owned by the Forest Department.

4.The petitioner appears to have been tricked into purchasing lands belonging to the Forest Department. Therefore, the petitioner's recourse would be against his vendor. Instead, the petitioner has approached this court seeking consideration of the representation for alternative land from the Government. This request cannot be granted by issuing a mandamus as prayed for. 5.Therefore, this writ petition is dismissed by leaving it open to the petitioner to initiate action against his vendor in accordance with law.
