PRAYER :- This Petition is filed under Section 528 BNSS, to quash the charge sheet in S.C.No.27 of 2023 on the file of the Additional District and Sessions Court for the Exclusive Trial of PCR Act cases, Thoothukudi, Thoothukudi District.

ORDER

The petitioners seek to quash the final report in S.C.No.27 of 2023 on the file of the Additional District and Sessions Court for the Exclusive Trial of PCR Act cases, Thoothukudi District, which was filed for the offences under Sections 147, 294(b), 323, 506(i) IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act and Sections 3(1)(r), 3(1)(s), 3 (2)(va) of the SC / ST (POA) Amendment Act, 2015.

2. The gist of the allegation is that on account of prior enmity, the petitioners had attacked the defacto complainant and others with sticks and hands, abused them in filthy language and abused the caste name of the defacto complainant and thus, committed the aforesaid offences. 2/6

3. Admittedly, the petitioners and the second respondent belong to the same village and they have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 15.10.2025.

4. The petitioners and the third respondent / defacto complainant and the respondents 4 to 7, who are the victims, are present before this Court in person. They are identified by Mr.G.Sritharan, SSI, Eral Police Station, Thoothukudi District. All the parties confirmed the compromise arrived at between them.

5. The learned Government Advocate (Criminal Side) would submit that the third respondent / defacto complainant has received a sum of Rs.2,00,000/- from the Adi Dravidhar Department and that a direction may be issued to the defacto complainant to deposit the said amount to the Department.

6. Considering the fact that the nature of offences and the relationship between the parties, this Court is of the view that no useful 3/6

purpose would be served by keeping the impugned final report pending trial. Accordingly, the impugned final report in S.C.No.27 of 2023 on the file of the Additional District and Sessions Court for the Exclusive Trial of PCR Act cases, Thoothukudi, Thoothukudi District, is quashed. The third respondent / defacto complainant shall deposit the sum of Rs.2,00,000/- within a period of two weeks from the date of receipt of a copy of this order, failing which, the order passed by this Court shall stand vacated without further reference to this Court.

7. In the result, the Criminal Original Petition stands allowed. The joint compromise memo dated 15.10.2025 shall form part and parcel of the order. The petitioners shall pay a sum of Rs.15,000/- (Rupees Fifteen Thousand only) as costs to the Mediation and Conciliation Centre attached to this Bench forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry. 29.10.2025 NCC : Yes / No Index : Yes / No Internet : Yes/ No LS 4/6
