This criminal miscellaneous petition has been filed to modify the condition imposed by this Court in Crl.O.P.(MD)No.19331 of 2023 dated 30.10.2023 directing the petitioners to execute their own bond instead of the condition to execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) each with two sureties each for a like sum and they should produce the solvency certificate to the satisfaction of the learned Judicial Magistrate No.VI, Madurai.
2.The learned counsel appearing for the petitioners would submit that the petitioners are accused in Cr.No.114 of 2023, which was registered for the offence punishable under Sections 304(II), 285 IPC and Section 164 of the Indian Railways Act and thereafter, they were arrested on 26.08.2023. Hence, they filed bail petition before this Court and the same was allowed on 30.10.2023 on condition that they should execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) each with two sureties each for a like sum and they should produce the solvency certificate to the satisfaction of the learned Judicial Magistrate No.VI, Madurai. Since they are the residents of the State of Uttarpradesh, unable to arrange sureties. Therefore, he would pray to modify the said condition.

3.Considering the facts and circumstances of the case and considering the fact that the petitioners are not the residents of the State of Tamil Nadu, the condition imposed on the petitioners is hereby modified to the effect that the petitioners shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) along with two common surety, in which one surety must be a Government Servant from the State of Uttarpradesh, to the satisfaction of the learned Judicial Magistrate No.VI, Madurai, within a period of three weeks from the date of receipt of a copy of this order.
