ORDER

This Criminal Original Petition is filed to quash the proceedings in S.P.S.C.No.13 of 2021 on the file of the learned Special Court for exclusive Trial of Cases under SC/ST (POA) Act, 1989.

2. After making submissions and when this Court was not inclined to accept the submissions, the learned counsel for the petitioner sought permission of this Court to withdraw this petition. The learned counsel for the petitioner has also made an endorsement to withdraw this petition.

3. However, he would submit that the petitioner is suffering from serious a Kidney ailment and he is undergoing dialysis. He has also produced medical records.

In view of the above submissions, the personal appearance of the petitioner before the trial Court is dispensed with, unless his appearance is considered necessary by the trial Court, for the progress of the trial of the case. The learned Special Judge for exclusive Trial of Cases under SC/ST (POA) Act, Sivagangai, may also expedite the trial of the case in S.P.S.C.No.13 of 2021 pending on his file.

5. With the above observation, this Criminal Original Petition is dismissed as withdrawn. Consequently, connected miscellaneous petition stands closed.
