This Criminal Original Petition has been filed to direct the second respondent not to harass the petitioner under the guise of enquiry for the complaint preferred by the third respondent.

2. The learned counsel for the Petitioner submits that the Petitioner is a Senior Citizen, he was earlier served as a Senior P.A. to the Minister of H.R. & C.E. Department. The Petitioner had purchased the property out of his own funds. The 3rd Respondent had approached the Police stating that the Petitioner had purchased the property, which is a disputed land. Considering the objection of the 3rd Respondent, the Petitioner had also filed a suit in O.S.No.117 of 2023 before the District Munsif, Theni, and the same is pending.

3. The learned counsel for the Petitioner further submits that on receipt of the complaint from the 3rd Respondent, the Respondent Police without any summons properly issued to him, he was called upon. The Petitioner appeared before the Respondent Police only on oral summon and he had produced all the documents relavant to the complaint. The 2nd 2/4

Respondent Police had not been satisfied with the documents furnished by the Petitioner and unnecessarily summoning him to Police Station. Therefore, he had approached this Court by seeking direction.

4. The learned Government Advocate (Crl.side) submits that the 2nd Respondent had conducted enquiry and closed the case as "civil dispute".
