To set aside the judgment and decreetal order passed by the Learned SubJudge, Kulithalai in A.S.No.46 of 2010 dated 29.09.2011, reversing the judgment and decreetal order passed by the Learned District Munsif, Kulithalai, in O.S.No.134 of 2003 dated 29.12.2009 and allow the second appeal. ORDER : This civil miscellaneous petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s.K.S.KATHIRAVAN, Advocate for the petitioner, the court made the following order:- 1/3

This application is filed to return the original patta passbook marked as Ex.B1 by substituting the same with the certified copy issued by this Court.

2. It is categorically stated in Para No.4 of the affidavit filed in support of this petition that the petitioners are ready to produce the original Ex.B1 as and when directed to be produced by this Court.

3. In view of the specific undertaking given by the petitioners, this petition is ordered and the Registry is directed to return the original Ex.B1 document subject to replacing it with certified copy of the said document. It is made clear that the petitioners shall produce the original Ex.B1 document as and when directed to be produced by this Court.
