ORDER
Heard both sides.
2.The writ petitioner's husband is an agriculturist. On 03.02.2023, when he was grazing cattle, he came in contact with a live electric wire. In this regard, Crime No.22 of 2023 was registered on the file of Thirupachethi Police Station. Prima facie it appears that the deceased was not at fault. It is open to the writ petitioner to approach the jurisdictional civil Court for appropriate compensation. This liberty is granted. The respondents have issued the proceedings. 3.During the relevant time, TANGEDCO Proceedings No.6 dated 16.10.2019 was holding the field. It provided for payment of Rs. 5,00,000/- (Rupees Five Lakhs only) in case of fatal incidents as ex gratia payment. The said amount has since been enhanced to Rs. 10,00,000/- (Rupees Ten Lakhs only) vide TNPDLC Proceedings No.11 3/6
dated 21.12.2024. Even though the occurrence had taken place before the issuance of the said proceedings, I am of the view that in view of the pendency of the claim, the revised proceedings can as well be applied. 4.I direct the sixth respondent to pay the said amount within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioner as wife will be paid a sum of Rs.6,00,000/- (Rupees Six Lakhs only). The daughters will be paid a sum of Rs.2,00,000/- (Rupees Two Lakhs only) each. As already mentioned, the petitioner is at liberty to move the jurisdictional civil Court for enhanced compensation. It is needless to mention that the amount now awarded to be paid shall be duly adjusted.
