Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records in pursuance of the Death Certificate issued by the second respondent dated 22.12.2009 to the third respondent and quash the same and direct the respondents 1 and 2 to issue fresh death certificate by incorporating the place of death as at Meenakshi Mission Hospital and Research Centre, Madurai and permanent residence as at No.5, First Avenue, Bhavanisagar.

O R D E R

This Writ Petition has been filed calling for the records in relating to the Death Certificate issued by the second respondent dated 22.12.2009 to the third respondent and quash the same and direct the respondents 1 and 2 to issue fresh death certificate by incorporating the place of death as at Meenakshi Mission Hospital and Research Centre, Madurai and permanent residence as at No.5, First Avenue, Bhavanisagar.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1

and 2 and the learned counsel appearing for the third respondent.

3. Today when the matter was taken up for hearing, the learned counsel for the third respondent as well the respondents 1 and 2 submitted that the Writ Petitioner has already died. But so far, no steps have been taken on the side of the petitioner , to bring the legal heirs on record.

4. In view of the same, the Writ Petition is dismissed as abated. No costs.
