This petition has been filed to withdraw and transfer the above H.M.O.P.No. 243/2023, from the Sub Court, at Uthamapalayam, Theni District and transfer the same to Family Court at Tiruchirappalli. 1/4

2.The facts in brief:

The marriage between the parties were solemnized on 03.03.2023. Thereafter there was some misunderstanding between them. The respondent and his family demanded more dowry. Thereafter, the petitioner was ill-treated by the respondent. Hence, she initiated proceedings under the provisions of Domestic Violence Act. Thereafter the respondent filed the above said H.M.O.P. petition on the file of the Subordinate Judge, Uthamapalayam. Since the petitioner facing difficulty in attending the proceedings before Uthamapalayam, she filed this petition seeking transfer of the same.

3.Heard both sides.

4.The learned counsel for the respondent would submit that the matter may be transferred to the Sub Court, Trichy. 5.Considering the facts and circumstances of the case and considering the Submissions of the respondent, the H.M.O.P.NO.243 of 2023 filed by the respondent on the file of the Subordinate Court, 2/4

Uthamapalayam, is ordered to be withdrawn and transferred to the Subordinate Court, Trichy.

6.Accordingly, this transfer civil miscellaneous petition is allowed. No costs. Consequently, connected miscellaneous petition is closed. 20.02.2024 NCC :
