PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the Respondents to rectify the erroneous entry in the FMB Sketch by the corresponding sale deeds in favor of the 1/5
petitioner for the land in S.No.60/9A and 60/9C bearing patta No.47 situated at Arumbanoor II bit village, Madurai East Taluk, Madurai District and consequently direct the respondents to conduct a survey in respect of S.Nos. 60/9A and 60/9C by considering the petitioner's representation dated 27.07.2025 and 08.10.2025 within a stipulated time fixed by this court. ORDER
By relying on sale deeds dated 22.12.1970 and patta No.47 relating to land in S.Nos.60/9A and 60/9C, the petitioner seeks rectification of the FMB sketch pursuant to survey.
2.Learned Additional Government Pleader accepts notice on behalf of all the respondents. He submits that the petitioner's request would be considered by the Revenue Divisional Officer after a survey is carried out by the 3rd and 5th respondents.
3.As per the sale deeds submitted by the petitioner, land of one Thirumalai Kone is said to be to the south of the petitioner's land. The FMB 2/5
sketch, however, indicates that the land of Thirumalai Kone in S.No.60/9B lies in the middle of the two parcels of land owned by the petitioner. In these circumstances, it is necessary to put the said Thirumalai Kone on notice before a decision is taken with regard to survey and rectification. 4.Subject to the above observations, this writ petition is disposed of by directing the 3rd and 5th respondents to initiate action on the petitioner's request for survey after issuing notice to Thirumalai Kone and owners of other adjoining lands and considering objections, if any, from them. Upon conclusion of such survey, the Revenue Divisional Officer is directed to consider the petitioner's request for rectification of the FMB sketch. The survey process shall be concluded within two months from the date of receipt of a copy of this order and the Revenue Divisional Officer is directed to pass orders on the petitioner's request for rectification within two months from the conclusion of such survey. No costs.
