PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 2nd respondent to conduct survey and demarcate the four boundaries of petitioner's property situated in S.No.90/1B situated at Melakuilkudi Village, Madurai West Taluk, Madurai District by considering petitioner's application vide payment of challan dated 08.12.2023 within the time fixed by this court.

ORDER

By relying on sale deed dated 08.02.2023 and patta No.4349 in the name of the petitioner, the petitioner had applied for a survey of the land in S.No.90/ 1B. The present writ petition relates thereto.

2. Learned Additional Government Pleader accepts notice on behalf of all the respondents. He submits that the petitioner's application would be acted upon and that all necessary measures would be taken within eight weeks from the date of receipt of a copy of this order.

3. On instructions, learned counsel for the petitioner confirms that there is no rival title claim. The petitioner has placed on record both title and revenue records relating to the relevant property. Therefore, a case is made out to consider the petitioner's application.

Accordingly, this writ petition is disposed of by directing the first and second respondents to initiate action on the petitioner's application for survey and complete the entire process within eight weeks from the date of receipt of a copy of this order, after issuing notice to owners of relevant adjacent lands and considering objections, if any, from them.
