(MD)No.128 of 2022.
COMMON ORDER These Civil Miscellaneous Petitions have been filed to condone the delay of 479 days in filing the petition seeking to set aside the abatement caused due to the death of the 3rd respondent, to set aside the abatement caused due to the death of the 3rd respondent, and to bring on record respondent Nos.4 to 7 as the legal heirs of the deceased 3rd respondent and rank them as respondent Nos.4 to 7 in the Second Appeal in S.A. (MD)No.128 of 2022 on the file of this Court. 2/5
2. Heard the learned counsel appearing on either side, and I have perused the affidavits filed in support of these petitions.
3. Ms.M.Rajeswari, learned counsel, submitted that she has filed a vakalat for respondent Nos.4 to 7 today and has not raised any objections to allow these petitions.
4. The learned counsel for the 1st respondent as well as the learned counsel for the 2nd respondent have also not raised any objections to allow these petitions.
5. Being satisfied with the reasons stated in the affidavits, these Civil Miscellaneous Petitions are allowed.
11-11-2025 Note : The Registry is directed to carry out necessary amendments in the appeal memorandum and list the same, along with the Second Appeal in S.A.(MD)No.220 of 2023, on 25.11.2025.
