PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned Order of the fifth Respondent vide his proceedings in RPOH 75/92 dated 16.12.1992 and quash the same as illegal, consequently, direct the Respondents issue patta in favour of the Petitioner in respect of the Natham Survey No. 939/43 for an extent of 296 Sq.ft. is situated at Santhaipettai, Ayyalur Village, Vedasanthur Taluk, Dindigul District. O R D E R

An order dated 16.12.1992 cancelling the patta issued to the petitioner's mother is challenged in this Writ Petition.

2. Learned counsel for the petitioner submits that a house has been constructed in Natham Survey No.939/43 of an extent of 592 square feet and that the petitioner is in possession thereof.

3. Learned Special Government Pleader accepts notice for all the respondents. He submits that the petitioner has approached this Court 2/5

after a considerable delay and that the affidavit does not contain an acceptable explanation in respect thereof. Therefore, he submits that this Writ Petition is liable to be dismissed.

4. The impugned order was issued on 16.12.1992 cancelling the patta issued to the petitioner's mother. The petitioner's mother passed away on 25.11.2023. Therefore, she was alive for more than 30 years after the impugned order was issued. The affidavit in support of this Writ Petition also does not provide an explanation for the delay. Although limitation does not apply to Writ Petitions, laches are a material consideration.

5. For reasons aforesaid, this Writ Petition is dismissed without any order as to costs. Consequently, connected miscellaneous petition is closed.
