ORDER

The present miscellaneous petition has been filed seeking to extend the time granted by this Court to vacate the premises. 1/5

By order dated 15.07.2025, recording the undertaking affidavit filed by the petitioner, this Court has directed the petitioner to vacate the premises on or before 30.10.2025 and handover the possession to the respondents failing which the respondents are at liberty to approach the jurisdictional police to carry out the eviction. The petitioner was also directed to pay the admitted rent to the respondents. For better appreciation, the relevant paragraph is extracted hereunder:- 4.In view of the subsequent developments and in view of the affidavit filed by the petitioner, the petitioner is directed to vacate and hand over the premises on or before 30.10.2025, and hand over possession to the respondents/landlords, failing which the respondents/landlords are at liberty to approach the jurisdictional police to carry out the eviction. If such request is made by the respondents, the jurisdictional police shall evict the petitioner and hand over possession to the respondents/landlords. In the meanwhile, the petitioner is directed to pay the admitted rent to the respondents/landlords.

3. The present application had been filed by the petitioner expressing certain financial and practical difficulties in evicting the premises within the time stipulated by this Court and seeking further three months time from 30.10.2025.

One another reason attributed by the petitioner is that the petitioner has paid an advance of Rs.2,20,000/- and had sought the respondent by way of legal notice to refund the advance amount after deducting four months rent payable by him. This fact had not been placed before this Court while order dated 02.07.2025 was made.

5. There is a specific direction to the petitioner to make the monthly rents to the respondents. The said condition has not been complied with.That apart, having undertaken to vacate the premises on the date fixed by this Court, the petitioner is trying to wriggle out of the said undertaking by seeking extension for a further period of three months. This conduct of the petitioner is contemptuous. 3/5

6.For the aforesaid reasons, I do not find any merits in the miscellaneous petition and accordingly, the same stands dismissed. However, there shall be no order as to costs. 29.10.2025 Index : Yes/No Internet : Yes/No NCC : Yes/ No GBA 4/5
