PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to instruct the 2nd and 3rd respondents to survey the petitioner's lands under Old S.No.95/3 its new S.No.95/44 measuring to an extent of 0.02.5 ares and lands under Old S.No. 95/3B its New S.No.95/45 measuring to an extent of 0.04.5 Ares situated at Mavayal Village, Aavudaiyarkovil Taluk, Pudukkottai District based on the petitioner's representation dated 13.09.2025 within the time fixed by this court. ORDER

By this writ petition, the petitioner seeks a survey of lands in S.Nos.95/44 and 95/45.

2.Learned Special Government Pleader accepts notice on behalf of all the respondents. He has placed on record the survey report. He points out that the petitioner refused to sign such survey report. 3.If the petitioner is aggrieved by the survey, the petitioner has an appellate remedy before the Assistant Director of Survey. Instead of availing of such appellate remedy, the petitioner approached this court to request for a resurvey. This approach cannot be countenanced. 4.Therefore, this writ petition is disposed of by leaving it open to the petitioner to file an appeal against the survey before the Assistant Director of Survey. No costs.
