PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Cr.No.290 of 2024 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 194(3) of BNS, 2023 r/w. Sections 9, 10 and11 of Child Marriage Act r/w. Sections 5 (1) and 6 of Protection of Children From Sexual Offences Act r/w. Section 107 of BNS, 2023, in Crime No.290 of 2024, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is the husband of the deceased. The petitioner is alleged to be a drunkard and frequently quarrelled with the defacto complainant's sister. On 18.10.2024, at about 5.00 a.m., the defacto complainant's sister committed suicide by hanging. Hence, the complaint.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent Police submits that the petitioner is the husband of the deceased. The petitioner is alleged to be a drunkard and frequently quarrelled with the defacto complainant's sister. On 18.10.2024, at about 5.00 a.m., the defacto complainant's sister committed suicide by hanging. He further submits a non-bailable warrant was issued on 12.08.2025.

Considering the facts and circumstances of the case, this Court is directing the petitioner to surrender before the Fast Track Mahila Court (Mahaleer Neethimandram), Ramanathapuram and file a recall application. On such application, the learned Judicial Magistrate shall consider the same in accordance with law on merits on the same day. 3/5

6. With the above said directions, this Criminal Original Petition is closed.
