By relying on a sale deed dated 04.11.2011 and an extract from the Town Survey Land Register pertaining to the land in survey No.2263/3B, the petitioner had applied for the conduct of a survey. The present Writ Petition relates thereto.
2. Learned counsel for the petitioner submits that there is no dispute with regard to title to the property. It is, however, submitted that third parties have encroached on the pathway to the petitioner's property.
3. Learned Special Government Pleader accepts notice for respondents 1 to 3 and learned Government Advocate (Crl.Side) accepts notice for the fourth respondent. Learned Special Government Pleader 2/5
submits that action would be initiated on the petitioner's request for a survey and necessary measures would be taken within three (3) months from the date of receipt of a copy of this order.
4. The petitioner has placed on record the title and revenue records indicating that the petitioner has rights in relation to the relevant property. Therefore, a case is made out for consideration of the petitioner's application.
5. Accordingly, this Writ Petition is disposed of by directing the second and third respondents to initiate action on the petitioner's request for a survey and complete the process within three (3) months from the date of receipt of a copy of this order after issuing notice to the owners of adjoining lands and considering objections, if any, from them.
