ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 498(A), 294(b) and 506(i) of IPC, in Crime No.14 of 2024, on the file of the respondent police, seeks anticipatory bail. 1/4

2. The allegation against the petitioner is that he made a false promise to marry the defacto complainant and subsequently tied the 'thali' before the Samayapuram Mariamman Temple. However, the petitioner completely denies this, specifically stating that no marriage took place.

3. The contention of the defacto complainant is that earlier there was a promise, and subsequently they got married and have a child. Moreover, the petitioner had taken lakhs of rupees from the defacto complainant and also four sovereigns of gold.

4. It is the specific allegation of the de facto complainant that the petitioner left the matrimonial home without informing her. The learned counsel appearing for the petitioner submitted that Section 498A of the IPC will not be attracted against the petitioner.

5. However, considering the facts of the case, this Court is of the considered opinion that if the marriage is denied while living together, it would amount to cruelty. Therefore, the petitioner's contention cannot be accepted. 2/4

6. Accordingly, this Criminal Original Petitions stands dismissed. The respondent police is directed to arrest the petitioner/accused. 21-11-2025 [2/2] KSA Note : Issue a copy of order on 12.12.2025 3/4
