PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of Certiorarified Mandamus, to call for the records in pursuant to the impugned 2nd Sale Auction Notice issued by the respondent in his proceedings dated 15.09.2025 and quash the same and consequently direct the respondent to return the House Deed which is submitted as Mortgage for the Business Loan Account Number 560371000367420 on the file of the Closure of Loan.

2. The petitioner challenges the correctness and validity of the auction proceedings, which was scheduled to be held on 15.09.2025.

3. Taking into consideration that the petitioner has already approached the Debts Recovery Tribunal challenging the sale notice and various grounds have been urged, we are not inclined to grant any indulgence, more so when there are no exceptional circumstances for the writ court to open parallel proceedings.
