ORDER

The petitioner seeks a direction to transfer the investigation in Crime No. 346 of 2025 from the file of the second respondent to third respondent or any other investigation agency. 2.The case of the petitioner is that he had initially lodged a complaint on 08.05.2025 alleging the commission of the offences under Sections 296(b), 131, 324(2), 329(3), 351(3) of BNS and Section 4 of TNPHW Act; that the second respondent initially refused to register the case; that the petitioner filed Crl.M.P.No.2434 of 2025 before the learned Judicial Magistrate, Thirumangalam, seeking a direction under Section 156(3) of Cr.P.C; that the learned Magistrate directed the respondents to register the FIR and consequently, FIR was registered; that the accused has not been apprehended so far and if the second respondent, who had already taken a view, is allowed to continue with the investigation, the petitioner would not get justice and that sought for transfer of investigation.

3.The learned Additional Public Prosecutor appearing for the respondents would submit that pursuant to the direction of the learned Magistrate, an FIR has been registered; that the investigation is being conducted in an effective manner and that there is no reason to transfer the investigation.

4.It is seen that though the second respondent had taken a view on the petitioner's complaint earlier, the FIR has now been registered on the direction of the learned Magistrate. This Court finds no reason to transfer the investigation at this stage, as the FIR has been recently registered. However, to ensure fairness, the Assistant Superintendent of Police, Thirumangalam Town, shall monitor the investigation conducted by second respondent. The second respondent shall conclude the investigation in Crime No.346 of 2025 and file a final report within a period of two months from the date of receipt of a copy of this order. 5.With the above observations, this Criminal Original Petition is disposed of.
