PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents 1 to 3 to take necessary action to restore the petitioner's landed property of an extent of 23 cents situated at Kongar Puliyankulam Village, Tirumangalam Taluk, Madurai District as per the Registered Partition deed dated 06.05.2016 vide document No.761/2016 and also by considering petitioner's representation dated 07.08.2025 within the time stipulated by this Court.

The petitioner asserts that a partition deed dated 06.05.2016 was executed after his father's death and that he was allotted the 'C' schedule property under such partition deed. According to the petitioner, his brother, the fourth respondent grabbed 23 cents of his property and that the FMB sketch was wrongly prepared. After submitting representations dated 21.01.2023, 29.05.2023 and 07.08.2025, the present Writ Petition has been filed.
2. Learned Additional Government Pleader accepts notice for 2/5
respondents 1 to 3. He submits that the Revenue Divisional Officer is the appropriate authority to consider the request of the petitioner for rectification of the FMB sketch and for cancellation of the patta standing in the name of the fifth respondent.
3. In view of the above submissions, the Revenue Divisional Officer, Madurai, is suo motu impleaded as the sixth respondent in this Writ Petition. The order shall be issued after carrying out the amendment in this Writ Petition.
4. Learned Additional Government Pleader further submits that the Revenue Divisional Officer would provide a reasonable opportunity to the petitioner and the private respondents herein before passing orders pursuant to an inquiry.
5. Therefore, it is not necessary to issue notice to the private respondents herein. Instead, this Writ Petition is disposed of by directing the Revenue Divisional Officer to consider the petitioner's request for rectification of the FMB sketch and cancellation of patta by conducting 3/5
an inquiry and providing a reasonable opportunity to the petitioner and the private respondents herein. A speaking order shall be issued within three (3) months from the date of receipt of a copy of this order. No costs. NCS : Yes/No 23.10.2025 Index : Yes / No Internet : Yes / No apd To
