ORDER

This petition has been filed to quash the First Information Report in Crime No.135 of 2025 on the file of the respondent Police, registered for the offences punishable under Sections 194(2) of BNS, 2023.

The gist of the allegation in the impugned FIR is that there was a dispute with regard to renovation of the toilet in the house of the petitioner and his relatives; that both the parties were fighting with each other in a public place and were causing breach of peace and thus committed the aforesaid offences.

The learned counsel for the petitioner would submit that the petitioner was not present at the scene of occurrence; that he produced certain documents to show that the petitioner was travelling at the relevant point of time; and that the dispute took place near the house of the petitioner and not in a public place and hence, the impugned FIR may be quashed.

4. The learned Government Advocate (Crl.Side) would submit that the allegation in the impugned FIR is that two groups of people were fighting with each other in a public place and were causing breach of peace. 2/4

5. This Court, at this stage, cannot hold that the allegations made in the FIR are false. The case of the petitioner is that he was not present at the scene of occurrence and that the occurrence did not take place in a public place. It is for the first respondent Police to conduct investigation and file a final report after taking into consideration all these aspects. Therefore, this Court is not inclined to entertain this petition, as this Court cannot adjudicate factual disputes in a quash petition.

6. With the above observations, this Criminal Original Petition is dismissed.
