This petition has been filed to condone the delay of 250 days in filing the Civil Miscellaneous Appeal.
2. Notice has been served on R1 to R4 and they are represented through counsel. Insofar as R5 is concerned, even though notice has been served, there is no representation either in person or through counsel and the name of R5 has been printed in the cause list and R6 remained ex-parte before the Tribunal and hence, notice is dispensed with.
3. Considering the reasons stated in the affidavit filed in support of the petition, this petition is allowed and delay is condoned.
4. Registry is directed to number the appeal, if it is otherwise in order and while listing the appeal for admission, the name of the counsel appearing on behalf of the respondents 1 to 4 shall be printed in the cause list.
