PRAYER :- This Criminal Original Petition is filed under Section 528 BNSS, to call for the records pertaining to the First Information Report in Crime No.549 of 2025 on the file of the 1st Respondent and the quash the same as illegal.

ORDER
This Criminal Original Petition is filed seeking to quash the FIR in Crime No.549 of 2025 on the file of the first respondent Police, which was registered for the offences under Sections 296(b), 191(2), 191(3), 115(2), 118(1), 351(3) and 109 of BNS, 2023.
2. The allegation in the FIR is that on account of prior enmity, the petitioners attacked the defacto complainant with a hand, knife and bottles, abused him in filthy language and also threatened him with dire consequences and thus, committed the aforesaid offences. 2/9
3.The learned counsel for the petitioners and the learned counsel for the defacto complainant/the second respondent would submit that the parties have now entered into a compromise on the advise of the elders and well-wishers and both the parties have agreed that the impugned F.I.R may be quashed.
4.The parties have also filed a joint compromise memo dated 14.10.2025. The scanned copy of the compromise memo reads as follows:

5.The petitioners, namely, Kirubanandham @ Kirubanandhan (Aadhaar No.3201 4751 6995), Pavasudhan @ Bhavasudhan (Aadhaar 6/9
No.8581 3990 9359), Veeramani (Aadhaar No.5076 5059 1150), Baskar (Aadhaar No.5985 1058 1724), Sanmuganidhan @ Shanmuganithan (Aadhaar No.8132 4753 0527), Jothi @ Jothipasu (Aadhaar No.2207 8970 8659), Saran (Aadhaar No.7315 8118 4184) and the second respondent, namely, Shanmugavel (Aadhaar No.5233 0446 3373), are present before this Court in person. They are identified by Mr.K.Manisekaran, Sub Inspector of Police, Kulithalai Police Station, Karur District. All the parties confirmed the compromise arrived at between them.
6.Though the petitioners are accused of the offence under Section 109 of BNS, the nature of the injury is not specified in the final report and there is nothing in the impugned final report to suggest that the petitioners are guilty of the offence under Section 109 of BNS. In any case, the defacto complainant is not willing to pursue the case and the chances of conviction are bleak.
7. Therefore, Considering the nature of the offences and the fact that the parties have arrived at a compromise, this Court is of the view 7/9
that no useful purpose would be served by keeping the impugned FIR pending investigation. Accordingly, the impugned FIR in Crime No.549 of 2025, on the file of the first respondent police, is quashed and the Criminal Original Petition stands allowed.
