Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the Respondent to Consider the representation dated 25/05/2025 and Consequently, to remove the excess area measurements of New Survey No.400/21 which was added erroneously to existing Patta bearing number 1234 issued for New Survey Number 400/18 and Old Survey Number.176/1A1A, Vallam North village, Thanjavur Taluk and District and remove Petitioner's late maternal grand father's name Jamal Deen as a co-owner and to pass suitable orders rectifying the discrepancies entered in existing Patta bearing number 1234 and to issue 2 separate corrected pattas for survey Nos.400/18 & 400/21. 1/4

By relying on a settlement deed dated 28.09.1977, a death certificate dated 26.06.2013 and a legal heirship certificate dated 23.08.2013, the petitioner had applied for rectification of patta No.1234 on the ground that the patta should be issued not only in respect of survey No.400/18, but also in respect of survey No.400/21.

2. Learned counsel for the petitioner relies upon the FMB sketch relating to survey No.400 and states that the online records do not contain any reference to survey No.400/21.

3. Learned Government Advocate accepts notice for the sole respondent. He submits that the petitioners' representation would be considered and disposed of on merits after issuing notice to all the pattadars or their legal heirs.

4. Patta No.1234 stands in the names of the three petitioners and one Jamal Deen. Learned counsel for the petitioner submits that the said Jamal Deen is the maternal grandfather of the petitioners and that he is no more. If so, notice should be issued to all the legal heirs of Jamal Deen, since he is a pattadar.

Subject to the above observations, this Writ Petition is disposed of by directing the respondent to consider and dispose of the petitioners' request for rectification on merits within three (3) months from the date of receipt of a copy of this order after issuing notice to all the pattadars or their legal heirs.
