PRAYER:

Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents to pay compensation at the market value for the petitioner's land in S.No.68/5, Phymas No.24 in Villipathiri Village of Aruppukottai Taluk which was taken possession without resorting the procedure contemplated under land Acquisition Act based on the petitioner's representation dated 06.09.2011.

For Petitioner : Mr.Karthick Raja for M/s.J.Gunaseelan Muthaiah For Respondents : Mr.A.Muthukaruppan Additional Government Pleader.

ORDER

This Writ Petition is filed for directing the respondents to pay compensation based, on the petitioner's representation dated 06.09.2011.

2. Heard Mr.Karthick Raja, learned counsel for the petitioner, Mr.A.Muthukaruppan, learned Government Pleader, for the respondents.

3. The learned counsel for the petitioner would submit that it would suffice if a direction is issued to the first respondent to consider the representation of the petitioner.

4. Mr.A.Muthukaruppan, learned Additional Government Pleader for the respondents would submit that the petitioner had given representation in the year 2011 and if a fresh representation is given, the first respondent would consider the same.

5. Considering the above submissions, the petitioner is directed to give a fresh representation to the first respondent by enclosing a copy of this order within a period of two weeks from the date of receipt of a copy of this order. Thereafter, the first respondent shall consider the same and pass orders on merits and in accordance with law within a period of three months therefrom.

6. Accordingly, this Writ petition is disposed of. No costs.
