O R D E R

The Criminal Miscellaneous Petition has been filed with the following prayer:

"to direct the Registry to advance the hearing of the case in Crl.M.P.(MD)No.14026 of 2025 in Crl.R.C(MD)No.1315 of 2025." 2.Heard Mr.A.Arun Ramnath, learned Counsel for the petitioner and Mr.A.S.Abul Kalam Azad, learned Government Advocate (Crl.side) for the second respondent.

3.This Court, vide order, dated 09.10.2025, had passed the following order:

"This Criminal Revision Case is filed with the following prayer:- "To call for the records pertaining to the judgement dated 13.08.2025 passed in Crl.Apl.No.12 of 2025 on the file of the Additional and District Sessions Judge, Ramanathapuram confirming the judgement dated 27.12.2024 passed in S.T.C.No. 1898 of 2022 on the file of the learned Judicial Magistrate Court No.II, Ramanathapuram and set aside the same." 2.Today, when the matter is being taken up, Mr.A.Arun Ramnath, learned counsel for the petitioner prays this Court to permit him to implead the Superintendent of Police, Madurai Central Prison, Madurai, as second respondent in the present Criminal Revision Case.

3.Accordingly, as prayed for by the learned counsel for the petitioner, this Court directs the petitioner to implead the Superintendent of Police, Madurai Central Prison, Madurai as the second respondent in this Criminal Revision Case. 4.The learned counsel for the petitioner further submits that the petitioner has already deposited 10% of the compensation amount ie., a sum of Rs.75,000/- before the Trial Court and now, the petitioner is ready to deposit further 50% of the compensation amount, apart from the amount already deposited before the Trial Court and prays adjournment to deposit further 50% of the compensation amount. 5.Mr.A.S.Abul Kalam Azad, learned Government Advocate, who has accepted notice on behalf of the second respondent, submits that he has no objection to the aforesaid prayer made by the learned counsel for the petitioner and also prays one week time to file objection to the Criminal Revision Case for the second respondent.

6.Accordingly, as prayed for by the learned counsel for the petitioner, this Court grants 10 days time to the petitioner to deposit further 50% of the compensation amount, apart from the amount already deposited before the Trial Court. In this regard, the learned counsel for the petitioner is directed to produce the deposit receipt before this Court on the next date fixed. In the meantime, the learned Government Advocate shall file his objection, if any, to the Criminal Revision Case for the second respondent and the learned counsel for the petitioner shall also file a reply to the objection filed by the second respondent within such time.

7.Put up this case on 23.10.2025 for consideration of the application for suspension of sentence and for grant of bail to the petitioner, before the appropriate Bench."

4.Today, when the matter is being taken up, Mr.A.Arun Ramnath, learned Counsel for the petitioner submits that in compliance of the order passed by this Court, dated 09.10.2025, the petitioner has deposited 50% 3/6

of the compensation amount, ie., Rs.3,72,125/- before the Judicial Magistrate No.II, Ramanathapuram, on 09.10.2025. The learned Counsel for the petitioner also submits that he has also filed the deposit receipt along with the present application, which is on record. The learned Counsel for the petitioner further submits that the matter is very urgent, as the petitioner is in jail and thus, he prays that the application for suspension of sentence may be heard by this Court by fixing an early date.

5.Mr.A.S.Abul Kalam Azad, learned Government Advocate (Crl.side) has no objection to the prayer made by the learned Counsel for the petitioner.

6.Accordingly, after considering arguments, as advanced by the learned Counsel for the petitioner and also considering the fact that the petitioner has deposited 50% of the compensation amount, as directed by this Court, dated 09.10.2025, this Criminal Miscellaneous Petition is allowed.

7.List the Criminal Revision Petition case on 17.10.2025 for consideration of the application for suspension of sentence and for grant of bail to the petitioner, before appropriate bench. 16.10.2025 nsr 5/6
