PRAYER : Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records on the files of the 2nd respondent pertaining to its order of withholding the petitioner's results for direct recruitment of Graduate Assistant Teachers through employment registration state seniority 2010-2011 for production of SSLC certificate and quash the same and consequently direct the respondents to issue appointment order to the petitioner. For Petitioner :Mr.S.C.Herold Singh For Respondents :Mr.R.Sethuraman Special Government Pleader.
O R D E R
The relief sought for in this writ petition to direct the second respondent to provide appointment to the post of Graduate Assistant to the writ petitioner.
2.The writ petitioner has participated in the process of selection. However, he was not selected.
3.The learned Special Government Pleader appearing on behalf of the respondents brought to the notice of this Court even at the time of filing the writ petition, the writ petitioner was aged https://hcservices.ecourts.gov.in/hcservices/
about 51 years and now he would be aged about 58 years. This being the factum of the case, the question of providing appointment to the writ petitioner does not arise at all. This apart, the writ petitioner was unsuccessful in the selection and therefore, his case now after attaining the age of 58 years cannot be considered.
4.In this view of the matter no further adjudication needs to be undertaken in respect of the other grounds raised in this writ petition. Accordingly, the writ petition stands dismissed. However, there shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
