ORDER

This Criminal Original Petition is filed to quash the impugned final report in S.C.No.334 of 2025 on the file of the learned Principal District Judge, Tenkasi, which was filed for the offences under Sections 329(4), 296(b), 118(1), 351(3) of BNS, 2023 r/w. Section 4 of TN Prohibition of Harassment of Women Act, 2002 r/w. Sections 3(1)(r), 3(1)(s), and 3(2)(va) of SC/ST (Prevention of Atrocities) Act, 1989.

2. The allegation in the final report is that, on account of prior enmity, the petitioner attacked the de-facto complainant with his hands and a knife, abused her in filthy language, humiliated her on account of her caste, and thereby committed the offence of criminal intimidation.

3. The learned counsel for the petitioner would submit that the parties have now arrived at a compromise and they have filed a joint compromise memo dated 18.11.2025.

4. The learned Government Advocate (Criminal Side), on instructions, would submit that the de-facto complainant had received a sum of 2/5

Rs.1,80,000/- (Rupees One Lakh and Eighty Thousand only) as compensation from the Adi Dravidar and Tribal Welfare Department, and that a direction may be issued to the de-facto complainant to deposit the said amount to the said Department.

5. The petitioner, namely Arockiyaraj (Aadhaar No.7103 3185 1768), and the 3rd respondent, namely Vijaya (Aadhaar No.2020 3122 3494), are present before this Court in person. They are identified by Mr.T.Sankara Pandian, Head Constable, Kuruvikulam Police Station, Tenkasi District. All the parties confirmed the compromise arrived at between them, and that the 3rd respondent/de-facto complainant stated that she does not wish to pursue the case any further.

In view of the above, and considering the nature of the allegations against the petitioner, the relationship between the parties, and in view of the compromise arrived at between the parties, this Court is of the view that no useful purpose would be served in keeping the impugned final report pending trial. Accordingly, the impugned final report in S.C.No.334 of 2025 on the file of the Principal District Court, Tenkasi is quashed and this Criminal Original Petition stands allowed. The petitioner shall pay a sum of Rs.10,000/- (Rupees 3/5

Ten Thousand only) as costs to the Mediation and Conciliation Centre attached to this Bench forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry. The de-facto complainant shall deposit the sum of Rs.1,80,000/- (Rupees One Lakh and Eighty Thousand only) to the Adi Dravidar and Tribal Welfare Department within a period of four weeks from the date of receipt of a copy of this order, failing which, the order passed by this Court shall stand vacated without any further reference to this Court.
