PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 4th respondent to implement the order of the 3rd respondent in Na.Ka. No.8038/2024/Aa4 dated 08.11.2024 by conducting the field inspection and surveyed the property as per sale deed and physical enjoyment and subsequently rectify the error in FMB. ORDER

By relying on sale deed dated 30.05.2022 and patta No.5696, the petitioner had submitted a representation for the rectification of the FMB sketch so as to reflect the correct extent of 24.30 acres instead of 23.40 acres. As an order dated 08.11.2024 in favour of the petitioner was issued by the Revenue Divisional Officer, the petitioner seeks implementation of such order.

2. Learned Special Government Pleader accepts notice for all the respondents. He submits that the petitioner's request would be considered and disposed of by the Tahsildar within eight weeks from the date of receipt of a copy of this order.

3. As contended by learned counsel for the petitioner, by order dated 08.11.2024, the petitioner's request for rectification of the FMB sketch in line with the sale deed and patta has been accepted by the Revenue Divisional Officer. In these circumstances, the writ petition is disposed of by directing the Tahsildar to take note of such order and issue a corrected FMB within eight weeks from the date of receipt of a copy of this order. In relation to the issuance of a corrected FMB sketch, a survey may be undertaken. No costs. 29.10.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 2/4
