The petitioner had submitted a representation to the Revenue Divisional Officer complaining of the wrongful issuance of patta No. 1343 in the name of the fourth respondent. The present Writ Petition relates thereto.
2. Learned Government Advocate accepts notice for respondents 1 and 2 and learned Special Government Pleader accepts notice for the third respondent. Learned Government Advocate submits that the Revenue Divisional Officer may be directed to dispose of the appeal within three (3) months from the date of receipt of a copy of this order. 2/5
3. In view of the above submissions of learned Government Advocate, the Revenue Divisional Officer is suo motu impleaded as the fifth respondent in this Writ Petition. The order shall be issued after carrying out the amendment in this Writ Petition.
4. In view of the nature of relief claimed, it is unnecessary to issue notice to the fourth respondent in this Writ Petition. Instead, this Writ Petition is disposed of by directing the Revenue Divisional Officer to consider the petitioner's appeal seeking cancellation of patta No.1343 and dispose of the same on merits within three (3) months from the date of receipt of a copy of this order, after providing a reasonable opportunity to the petitioner and the fourth respondent herein.
