ORDER

The petitioner seeks for quashing of the FIR in Crime No. 233 of 2013 on the file of the first respondent police, for the alleged offences under Sections 147, 148, 323, 506(ii), 307 I.P.C.

2. The gist of the allegation is that on account of prior enmity, the petitioners had attacked the defacto complainant with hands / knives besides committing the offence of criminal intimidation and thus committed the aforesaid offences.

3. The learned counsel for the petitioner and the learned counsel for the defacto complainant/the second respondent would submit that the petitioner and the defacto complainant are closely related to each other and that the parties have arrived at a compromise and filed a joint compromise memo and both the parties have agreed that the impugned F.I.R may be quashed.

4. The parties have also filed a joint compromise memo dated 13th October 2025. The scanned copy of the compromise memo reads as follows:

5. The petitioner and the second respondent/ defacto complainant (Aadhaar No.2820 0854 9243) are present before this Court in person. They are identified by Mr.A.Jeyakumar, S.I., B1 Melur Police Station. Both the parties confirmed the compromise arrived at between them.

Though the FIR has been registered for the offence under Section 307 of the IPC, admittedly, none has been injured and therefore, this Court is of the view that the impugned prosecution can be quashed as the dispute is private in nature. Accordingly, the impugned FIR in Crime No. 233 of 2013 on the file of the first respondent police, is hereby quashed and the Criminal Original Petition stands allowed. The petitioners shall pay a cost of Rs.5,000/- (Rupees Five Thousand only) to the Mediation and Conciliation Centre attached to this Bench forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry.
