ORDER

This Criminal Original Petition has been filed seeking orders to grant leave to the petitioner to file the above criminal appeal in Crl.A.(MD)SR No. 18965 of 2025 against the order passed in Crl.A.No.50 of 2022, dated 30.10.2024 on the file of the learned Principal District and Sessions Judge, Pudukkottai.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent.

3.The petitioner/complainant filed a complaint for the offence under Section 138 of Negotiable Instruments Act and after trial, the learned Magistrate has passed a judgment of conviction. Challenging the same, the respondent has filed an appeal in Crl.A.No.50 of 2022 and the learned Principal District and Sessions Judge, allowed the appeal and acquitted the accused. Challenging the same, the present appeal came to be filed. 4.Considering the submissions made by the learned counsel on either side and also the reasons assigned, this Court is inclined to grant leave to the petitioner.

5.Accordingly, the Criminal Original Petition is allowed. Registry is directed to number the appeal, if it is otherwise in order and list the matter in the regular course.
