O R D E R
(Made by C.V.KARTHIKEYAN, J.) We had referred the issue to be examined through Mediation and Conciliation Centre. The report had been received from the Mediation which is as follows:
"As per the orders of this Hon'ble Court we have conducted Mediation today. Both parties and their counsels are present as per the orders of the Hon'ble Madurai Bench of Madras High Court today. The detenue by name B.Marjania Beham, the petitioner and the father of the detenue Mr.H.Bakrudeen, the children's of the detenue by name M.Aneefa Jumana and M.Saiful Azman and the Respondent Police, South Police Station Karaikudi represented through their Head Constable W.H.C.No.1735 Tmt.Nagajothi are present before Mediation Centre. Mediation was conducted between the parties. The detenue is not willing to go with her parents where her children are residing, and also detenue is not willing to reside at Karaikudi she wants to live at Chennai where she has employed in Beauty Parlour and getting a salary of Rs.18,000/- per month. The children of the detenue and father of detenue are chatting with each other for long time and there is no amicable settlement arrived between the parties in the Mediation process. 2/5
Since there is no amicable settlement between the parties, the matter has been refer back to this Hon'ble Court."
2.The learned counsel for the petitioner stated that ultimately it is the children who are the sufferers. We fervently hope that the petitioner/maternal grandfather would take care of the children and act as their guide in future. We are also confident that he has not completely severed his relationship with his daughter/detenue and at some point their relationship would be restored. We had called upon the detenue to give her address and phone number at Chennai, but unfortunately, she has given only her hostel address. Therefore, she has taken a definite view not to go along with the petitioner herein or her husband.
3.In view of the above said facts, no further orders are required. This Habeas Corpus Petition stands closed.
