The above petition has been filed seeking leave to file the appeal, challenging the judgment of acquittal made in S.T.C.No.526 of 2022 dated 14.11.2024 on the file of the Judicial Magistrate No.I, Fast Track Court, Madurai.

2. Heard the learned counsel appearing for the petitioner.

3. The learned counsel appearing for the petitioner would submit that the petitioner filed a private complaint under Section 200 Cr.P.C. against the respondents for the offence under Section 138 of Negotiable Instruments Act and after trial, the learned Magistrate dismissed the complaint and thereby acquitted the respondents. He would further submit that the respondents have not disputed the issuance of cheque and the signature found therein.

4. In delay condonation petition, despite receipt of notice, the respondents have not turned up.

5. Considering the affidavit filed in support of this petition and the impugned judgment, this Court is inclined to grant leave sought for. Accordingly, this petition is ordered.
